Memorandum of Understanding – Double Overtime

We are very pleased to have reached this timely agreement in collaboration with CUPE 1252, including Local 4848, and with the support of Department of Health and Treasury Board. MEMORANDUM OF AGREEMENT
BETWEEN
TREASURY BOARD AS REPRESENTED BY THE HOSPITAL BOARDS OF THE

AND
THE CANADIAN UNION OF PUBLIC EMPLOYEES, LOCAL 1252

RE:  Article 23- Overtime for employees of Ambulance New Brunswick (ANB)

Whereas the parties recognize that EM/ANB Inc. is currently facing significant staffing challenges with respect to all employees of Ambulance New Brunswick and

Whereas these challenges have negatively impacted the level of ambulance services that is required in the interest of the health and safety of New Brunswickers;

Therefore, notwithstanding Article 23 (Overtime) in the collective agreement signed between the parties on November 28, 2017 the parties agree to the following:

  • Effective immediately upon the signing of this agreement, overtime shall be compensated at two (2) times the regular rate of pay for all overtime hours worked by all employees of ANB;*
  • Employees of ANB shall only be eligible to receive double time for an overtime shift if they do not miss any shifts due to sick leave in the four (4) week period that they were scheduled to work. For example, if an employee misses a regularly scheduled shift in their rotation due to sick leave then the next OT shift will be compensated at one and a half (1.5) times the regular rate of pay or (1.5) times off in lieu for all overtime hours worked.  A subsequent OT shift would be paid at two (2) times the regular rate of pay for all hours worked, providing no other regularly scheduled shifts are missed in the rotation.*
  • This agreement will expire on September 4, 2019; and
  • The parties reserve the right to revert back to the current collective agreement, extend this agreement or any other as mutually agreed.

*Note: The time in lieu will also apply to double time shifts.

Mileage Expenses

In addition, employees of ANB working in the field who accept overtime shifts at a station outside their assigned region shall be eligible for reimbursement of mileage expenses in accordance with Appendix A – Allowances of the Government of New Brunswick’s Travel Policy for travel from their home station to the station outside their region.

The parties agree that this agreement does not set a precedent for other classifications covered by the collective agreement with regards to the compensation of overtime or the reimbursement of travel expenses.

This agreement shall not be subject to Section 46 (i.e. the “statutory freeze”) of the Public Service Labour Relations Act. The application of this agreement beyond September 4, 2019 can only be done by the parties’ written agreement.
